The Short Answer

A lady bird deed is an enhanced life estate deed. You keep the right to live in the house, sell it, mortgage it, or revoke the deed. A named remainder holder takes title at death. On that one parcel, probate is typically skipped. It is a recorder product in some states. It is not a living trust.

Where It Exists

Florida recorders have long accepted enhanced life estate deeds under that nickname. Michigan has no dedicated lady bird chapter. Recorders still take a life estate plus a lifetime power to convey. That power is treated as a power of appointment under the Michigan Powers of Appointment Act. Other states use a statutory transfer on death deed instead. Do not assume your county clerk has a lady bird form.

The nickname is folklore. Lady Bird Johnson is the story people tell. The legal fact is the enhanced life estate: you keep control that an ordinary life estate would give away. If your state does not recognize that deed, recording a downloaded PDF can leave a cloud on title.

What is a living trust is the CFPB definition. Living trust on a house is the recorded deed into the trustee, not a remainder clause.

What It Does Not Cover

  • Bank and brokerage accounts. Those need retitling or POD/TOD forms.
  • A second house in a state that does not honor lady bird deeds.
  • Paying bills if you are in the hospital. That is a successor trustee or a financial POA.
  • A guardian for a minor. That is a will.
  • Hiding the house from the IRS. Revocable control still looks like your house for tax.

Keisha’s Florida Parcel

Keisha records a lady bird deed on a condo in Tampa. Her son is the remainder holder. She later buys a brokerage account in her own name and a cabin in Georgia. When she has a stroke, nobody on the lady bird deed can sell the Georgia cabin or write checks from the brokerage. The Florida condo is set for death. Incapacity is a different hole. A funded trust plus a pour-over will would have covered the set.

If your search was lady bird because a neighbor used one, still start with the trust consult if you own more than that one parcel or you need a successor to act.

A remainder holder who is a minor, or who later files bankruptcy, can also complicate a lady bird. Those facts belong in a local deed consult. They are another reason we point homeowners with several assets to a funded living trust instead of a one-parcel remainder clause.
