The Short Answer
A power of attorney names an agent to handle your finances. Durable means that paper still works if you later cannot act. Banks, the tax collector, and a title company may still ask for their own form. The paper typically ends when you die. It does not transfer the house to heirs.

What Durable Means
Older common-law forms died the moment you lost capacity. That made them useless for a stroke. Uniform Power of Attorney Act states often treat a POA as durable unless it says otherwise. Other states still want the word durable on the page. Signing rules, springing vs immediate, and who may serve as agent are state law.
Springing means the agent can act only after a doctor letter. Immediate means the agent can act when you sign. Immediate is simpler for banks. It also requires a person you actually trust. Pick one agent and one backup. Do not name four people who must all appear at the teller window.
Now, Incapacity, Death
While you can act
You still sign. The agent is a backup. Immediate POAs can also act now if you allow it.
If you cannot act
Durable POA pays bills on accounts in your name. A successor trustee pays bills on trust accounts.
After death
The POA typically dies with you. Executor or successor trustee takes the next seat.
A funded trust and a durable POA overlap on bills. They are not duplicates. The trustee needs trust title. The agent needs accounts still in your name. Missing either paper leaves a hole. What is a successor trustee is the trust seat.
Not a Trust, Not a Living Will
Living will vs power of attorney is the hospital split. A living will is the treatment list. A healthcare proxy or medical POA is the speaker. A durable financial POA is the checkbook. Do not hand the ER a bank form.
A POA also does not skip probate. The agent cannot sit in court as if they were you after you die. What is probate is that file. If the house should stay out of court, fund a trust while you can still sign a deed.
Priya’s Bank Visit
Priya’s father has a stroke. She brings a general POA printed from a website. The branch will not honor it. The form is not durable. It also is not the bank’s affidavit. Meanwhile the mortgage auto-pay fails. A state-statute durable POA, plus a successor trustee on funded accounts, would have given her two doors. One PDF gave her none.
If the bank visit is the fear, start with the estate consult, not a blank form. We still cannot promise every bank will accept every paper on the first try. We can prepare the statute form that belongs in the packet.
Record who holds originals. An agent with a photocopy and no ID matching the name on the paper will still get turned away. Keep the signed POA where the agent can find it without rummaging through a safe you cannot open.
